But surely it’s appropriate for prosecutors in red states to start filing RICO charges against Joe Biden in any valid jurisdiction.

There’s plenty of evidence and the DOJ has proven itself… reluctant to pursue it.

After all, “no one is above the law”, even a sitting president, as Democrats used to argue when they wanted to indict Trump over the Russiagate hoax.

Fulton County courts refused.

Hence, Trump's election contest was never heard.
