I would like to think it would be legal because it is so logical for a lawyer to call the Judge on WVU team or Battles team and ask if his “no punishment for TRO playing time” would include loss of eligibility.
From my dummy perspective the NCAA is proving the exact point of the lawsuit….that they bully and threaten to punish the students who dare question their power and complete authority. If I were the judge I would make a statement and a ruling that would tie the NCAA up for months to even be able to appeal…there would be a penalty for publicly bullying the students with fear of punishment in spite of my ruling that there would be no punishment.
