Former, active-duty Army soldiers charged in scheme allegedly selling sensitive military information to China

Three U.S. Army soldiers – two active-duty and one former – have been indicted for their alleged roles in gathering and selling sensitive information to China, the DOJ said.

Two active-duty U.S. Army soldiers and one former soldier were arrested in Oregon on Thursday for their alleged roles in gathering and sending sensitive information to individuals in China, the Department of Justice said.


The accused are Jian Zhao and Li Tian, who were stationed at Joint Base Lewis-McChord, and former soldier Ruoyo Duan.

All three are charged with conspiring to commit bribery and theft of government property. Zhao is facing additional charges of conspiring to obtain and transmit national defense information to an individual not authorized to receive it.

"The defendants arrested today are accused of betraying our country, actively working to weaken America’s defense capabilities and empowering our adversaries in China," said Attorney General Pam Bondi. "They will face swift, severe, and comprehensive justice."

Michael Charles Schena, 42, of Alexandria, Virginia, was arrested on criminal charges related to his alleged participation in a criminal conspiracy to gather, transmit, or lose national defense information.

According to court documents, Schena is employed by the U.S. Department of State (DOS) working out of DOS Headquarters in Washington, D.C. Schena held a top secret security clearance and had access to information up to the secret level within his DOS workspace. Beginning in or about April 2022, Schena allegedly communicated with people he met online through various communication platforms and provided them with information they were not authorized to receive. In return, Schena received payments. On Feb. 27, Schena allegedly used a cellphone to take images of multiple documents, which were displayed on the monitor of his classified computer and marked as “SECRET.” Schena then allegedly left work and returned to his home in Alexandria, where the cellphone was seized.

Schena is charged with conspiracy to gather, transmit, or lose national defense information and faces a penalty of up to 10 years in prison. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.
 



The Justice Department, FBI, Naval Criminal Investigative Service, and Departments of State and the Treasury announced today their coordinated efforts to disrupt and deter the malicious cyber activities of 12 Chinese nationals, including two officers of the People’s Republic of China’s (PRC) Ministry of Public Security (MPS), employees of an ostensibly private PRC company, Anxun Information Technology Co. Ltd. (安洵信息技术有限公司) also known as “i-Soon,” and members of Advanced Persistent Threat 27 (APT27).

These malicious cyber actors, acting as freelancers or as employees of i-Soon, conducted computer intrusions at the direction of the PRC’s MPS and Ministry of State Security (MSS) and on their own initiative. The MPS and MSS paid handsomely for stolen data. Victims include U.S.-based critics and dissidents of the PRC, a large religious organization in the United States, the foreign ministries of multiple governments in Asia, and U.S. federal and state government agencies, including the U.S. Department of the Treasury (Treasury) in late 2024.

“The Department of Justice will relentlessly pursue those who threaten our cybersecurity by stealing from our government and our people,” said Sue J. Bai, head of the Justice Department’s National Security Division. “Today, we are exposing the Chinese government agents directing and fostering indiscriminate and reckless attacks against computers and networks worldwide, as well as the enabling companies and individual hackers that they have unleashed. We will continue to fight to dismantle this ecosystem of cyber mercenaries and protect our national security.”
