In Bouarfa v. Mayorkas (No. 23-583), issued on December 10, 2024,
SCOTUS ruled that federal courts cannot review visa revocations made by the U.S. Citizenship and Immigration Services (USCIS) or the Department of Homeland Security (DHS).

The Court held that these revocations are discretionary decisions, and Congress has explicitly placed them beyond judicial review. Justice Ketanji Brown Jackson, writing for the Court, emphasized that the Secretary of Homeland Security has broad authority to revoke an approved visa petition "at any time, for what he deems to be good and sufficient cause," and such actions are not subject to court oversight.This ruling distinguishes visa revocations from initial visa denials, which may still be subject to judicial review in certain cases.

However, once a visa is approved and then revoked, the decision is final and cannot be challenged in federal court, though petitioners may pursue in-agency options like filing a motion to reconsider or appealing to the Administrative Appeals Office.

Mohammed Khalil is going to be deported.

Continuing this court case is a waste of money and resources.

The DOJ should be asking for sanctions against the lawyers bringing this case.
