The Democrats are already gearing up with legal staffing, they're anticipating the election being challenged. Hillary Clinton already advised Biden to not to concede under any circumstances.

The election, I'm sure will be contested in the Supreme Court; the Trump administration must fill this position if they want to win this election.

The Republicans have everything they need to do it and more importantly, they have every right to fill it. If it was the other way around I can assure you the Democrats would fill it in a heartbeat.
